Given the hundreds of articles and books that have been written in epistemology over the span of just the past few decades, relatively little has been written specifically on epistemic responsibility. What has been written rarely considers the nature of epistemic responsibility and its possible role in epistemic justification or knowledge. Instead, such work concerns philosophical analyses and arguments about related concepts such as epistemic virtues or duties, rather than epistemic praiseworthiness and blameworthiness.2 It is epistemic responsibility in the blameworthiness (...) and praiseworthiness senses that is the primary concern of this paper, though the duty sense of epistemic responsibility is explored in terms of its pertinence to epistemic virtue. This essay provides a critical philosophical assessment of “offensiphobia,” which is the belief that higher educational academic freedom ought to be to some important extent censured because of the mere offensiveness of certain kinds of expressions, whether those expressions are perceived as being racist, sexist, etc., effectively holding that the offensiveness of such expressions is a sufficient condition to justify its prohibition. This paper concisely sets forth the general legal parameters of the United States constitutional First Amendment right to freedom (...) of expression. Subsequently, it follows Joel Feinberg in distinguishing between harms and offenses and explains why the law should only protect against harms and not mere offenses. Following this, logical and moral considerations are brought to bear in order to further assess the implicitly supporting view of offensiphobia that faculty and students in higher educational contexts have a claim right to not be offended correlated with a duty of others to not offend them. For example, the use-mention distinction is discussed in order to explain why linguistic intent is crucial for the determination of what genuinely counts as being racist, sexist or otherwise offensive discourse. In the end, there are a variety of reasons for thinking that there is no moral right to not be offended correlated with a moral duty of others to not offend in higher educational contexts and that the law and public policy ought to track this fact. Without a right to not be offended, those who seek to curtail higher educational academic freedom rights by way of censorship stand on unreasonable ethical grounds to do so, though the law seems to permit private institutions to delimit offensive expressions. In some recent articles, Dr. Leigh Turner [Doffing the Mask: Why Manuscript Reviewers Ought to Be Identifiable,” Journal of Academic Ethics, 1 (2003), pp. 41–48; “Promoting F.A.I.T.H. in Peer Review: Five Core Attributes in Effective Peer Review,” Journal of Academic Ethics, 1 (2003), pp. 181–188.] makes some rather critical observations regarding the processes of peer-review in academic journals. I shall note them in turn, note wherein I concur and wherein I disagree, and discuss some of Turner's suggestions to resolve such (...) difficulties. It is hoped that my comments on Turner's much-appreciated points will engage readers of this august and well-edited journal to take more seriously Turner's arguments for the sake of the betterment of academic research. What makes for excellence in research, teaching and service is explored in some detail, with attention paid to the contexts of four-year colleges and comprehensive universities in the united states.

Recently, there have been discussions about whether or not inter-collegiate football should be eliminated in the US. This article philosophically assesses the arguments for its elimination as well as the arguments proffered against its elimination. While a variety of arguments are discussed, a new one is brought into the foray of philosophical investigation, one that combines the unfairness and economic arguments: the health care and medical costs to others argument. This paper examines the recent actions by the United States in Iraq in the light of just war principles, and sets forth a program for holding accountable those most responsible for war crimes in Iraq.

Both fairness and efficiency are important considerations in market design and regulation, yet many regulators have neither defined nor measured these concepts. We develop an evidencebased policy framework in which these are both defined and measured using a series of empirical proxies. We then build a systems estimation model to examine the 2003–2011 explosive growth in algorithmic trading on the London Stock Exchange and NYSE Euronext Paris. Our results show that greater AT is associated with increased transactional efficiency and reduced (...) information leakage in top quintile stocks. For less liquid stocks, manipulation at the close declines. We also document the tradeoff between reduced spreads and increased manipulation or information leakage following the introduction of MiFID1. (shrink)

Conhecido como Debate Hart-Dworkin, o entrechoque de opiniões entre esses dois autores gerou intensa discussão acerca do positivismo jurídico e das teorias que buscam refutar suas teses fundamentais. Neste contexto, Ronald Dworkin se empenha em repreender a doutrina positivista demonstrando que as noções elementares dessa teoria não são capazes de produzir uma doutrina eficaz sobre a natureza do direito. No presente artigo, pretendo analisar as críticas lançadas por Dworkin ao positivismo jurídico e às conceituações de Herbert Hart, com específica atenção (...) para o conceito de discricionariedade que Dworkin imputa ao positivismo. A partir de uma discussão teórica envolvendo as principais obras desses autores, procuro confirmar a hipótese de que a teoria positivista moderna não está comprometida com o sentido atribuído por Dworkin à noção de discricionariedade, prejudicando assim o fundamento da crítica de Dworkin acerca da interpretação no positivismo jurídico. Ao final, irei considerar também a gravidade desta vicissitude para a teoria dworkiniana como um todo, avaliando se as críticas de Dworkin restam comprometidas ou resistem a este empecilho. (shrink)

In this paper I shall discuss various philosophical theories of collective punishment: marxian annihilism, metaphysical collectivism and methodological individualism. After refuting metaphysical collectivism and its modified version, I defend a modification of methodological individualism.

This paper investigates philosophically the question of whether or not college and university athletes in the USA are doing something morally wrong should they terminate their college or university experience prior to graduation and enter the professional athletic ranks. Various moral arguments are brought to bear in order to attempt to shed light on this issue. One reason why such athletes ?turn professional? before they graduate is the perceived economic exploitation they experience as essentially underpaid workers earning much revenue for (...) their respective institutions. But who is exploiting whom here? Is it just student athletes who are exploited by the system? I expand the reasoning about the exploitation of intercollegiate athletics to include not just student athletes, but their supporting colleges and universities. In the end, it is proposed that the National Collegiate Athletic Association and similar academically related athletic agencies should permit and encourage each of their constituent institutions as a matter of policy to protect themselves (and their supporting taxpayers, in the cases of public institutions) contractually from economic exploitation by professional sports franchises. Thus the question of student athletes leaving college for professional sports contracts has hidden beneath it questions of private professional sports franchises? exploitation of the institutions with which such student athletes are affiliated. We study the origin of quantum probabilities as arising from non-Boolean propositional-operational structures. We apply the method developed by Cox to non distributive lattices and develop an alternative formulation of non-Kolmogorovian probability measures for quantum mechanics. By generalizing the method presented in previous works, we outline a general framework for the deduction of probabilities in general propositional structures represented by lattices (including the non-distributive case).

This article is a critical philosophical assessment of John Searle’s theory of human rights as it is articulated both in his earlier book, The Construction of Social Reality and especially in his more recent book, Making the Social World.

We present a generalization of the problem of pattern recognition to arbitrary probabilistic models. This version deals with the problem of recognizing an individual pattern among a family of different species or classes of objects which obey probabilistic laws which do not comply with Kolmogorov’s axioms. We show that such a scenario accommodates many important examples, and in particular, we provide a rigorous definition of the classical and the quantum pattern recognition problems, respectively. Our framework allows for the introduction of (...) non-trivial correlations between the different species involved, opening the door to a new way of harnessing these physical resources for solving pattern recognition problems. Finally, we present some examples and discuss the computational complexity of the quantum pattern recognition problem, showing that the most important quantum computation algorithms can be described as non-Kolmogorovian pattern recognition problems. This paper is an elaboration of my previous paper published in Philosophy, ‘Making Sense of retributivism,’ which was a criticism of John Rawls' attempt in ‘Two Concepts of Rules’ to develop a rule utilitarian theory of punishment wherein utilitarianism is best construed as a justificatory basis for the institution of punishment and retributivism is best construed as serving as a justificatory basis for particular forms of punishment. I challenge this claim, arguing that retributivism must and can provide a justification both (...) for the institution of punishment and for particular forms of punishment. In the end, I develop an analysis of the nature of desert as responsibility and proportionality. This notion of desert makes the best sense of retributivism. (shrink)

Professor William Lane Craig argues that a particular set of concerns about the Christian doctrine of penal substitution (namely, that Jesus of Nazareth was sacrificed for the sins of humanity) can be satisfied. This article provides rebuttals to said replies in an attempt to render plausible the claim that God exists to the extent that God is perfectly just, and that divine justice requires, among other things, that God never engage in the harming of innocents, consistent with any doctrine of (...) retributivism worthy of the name. The doctrine of God, then, must remain consistent with unqualified negative retributivism. Any theism which might suggest otherwise violates such vital considerations of justice and fairness and must be rejected. (shrink)

In this study, we explored the time and space relationship according to two different spatial codings, namely, the left/right extension and the reachability of stimulus along a near/far dimension. Four experiments were carried out in which healthy participants performed the time and spatial bisection tasks in near/far space, before and after short or long tool-use training. Stimuli were prebisected horizontal lines of different temporal durations in which the midpoint was manipulated according to the Muller-Lyer illusion. The perceptual illusory effects emerged (...) in spatial but not temporal judgments. We revealed that temporal and spatial representations dynamically change according to the action potentialities of an individual: temporal duration was perceived as shorter and the perceived line’s midpoint was shifted to the left in far than in near space. Crucially, this dissociation disappeared following a long but not short tool-use training. Finally, we observed age-related differences in spatial attention which may be crucial in building the memory temporal standard to categorize durations. (shrink)

A intenção desse artigo é encontrar elementos que elucidem a gênese desse processo que se encontra, em especial, no curso proferido em 1919, entre outros.
